Divorce will be subject to the courts where you live.

 

Chinnappudu India lo cheskunnav ani malli akkadake velli divorce theskomani chepparu.

 

Recently i read that US and India will follow geneva /hauge convention of international justice.

As per this rule, any US court case on Indian residents ( those who reside in India) will have to be summoned through indian external affairs ministry.

 

Which means, if your friend files a case in US, he has to hire international lawyers who will send summons to Indian government, from there it has to be forwarded to Indian resident passport address or latest address.

This summon delivery would take a year it seems.

After that US court will receive acknowledgement, which if it has contesting, then they have to involve internal ministry, embassy to have court proceedings.

 

Easiest way is to get your friends wife to US settle mutually or ask your friend to go to India and settle in India courts.

Mutual consent is easy process ... 

 But if any cases are filed .. first clear them .. then clear it.. 

Don't fall into pray of getting divorce before any cases are cleared

i handled this for one of my friend...first ask them both to meet and whats the conditions..then tell ur guy to hire both lawers for both sides that way other guy wotn switch at nth hour...third try to not put more blame on either last and final on the day of 3rd hearing carry some cash (50-1L) depending on the worth of both and pass on to judge and they sign after court hours
