NRI agriculture property buying legal issues - FEMA Act

After listening this I read more about it online and it looks like it's true. Edhi telika last year oka 10 Acers konna half on my name and half on parents name. Not sure amavtundho.

Mari mana NRI tejalu full ga kotuunaru ga... Is there any work around to avoid these legal complications?

Direct parents name pai koni then after an year gift deed on your name chesukunte any issue ?

That used to be safe way…but iyalrepu siblings vunte contest chese chance vundi…even though on paper it may appear as self acquired property by parents, gift deed chesinaka siblings can contest…

but vunna options la ide better route…

nope even if we do this way law is still favor to FEMA anta, they will say we intendedly bought property on parents name with knowing that we will get it later part of the life anta. only inherit nuchi vache land ithae acceptable anta

who is they? is there any record of govt making an issue of this?

That happenes when an NRI leaves money trail. Like NRI sending money to parents to buy property and then creating a gift deed, that will leave a trail of money and may work against in case of legal disoute but good thing endi ante thenparty which should dispute is the state govt…and such a thing has never happened kabatti bindaas ae vundochu

ok so in my case I sent money into my parents account to buy that property, would that be a problem then?

to my best knowledge, emaina legal issues vastene ee complications. if all goes smooth, you will be fine. I know some guys who brought and sold agri land, no issue caused to any. they even put in papers they are nris.

I’m in the same boat.. bough farm land before this rule… what happens now ? Rule vachaka konte problem aaa mundu konna valla situation enti ?

It would be a problem if someone disputes and in this situation, the only disputing party is the state government. As long as the state does not dispute, yo have nothing to worry about and the state will not come after you.
