  • H1B denial rate jump to 24% from 10% between 2016 and 2020. Same time lot of 221g at Consulate so people were afraid to travel specially from consulting companies. Lot of RFE were sent to IT folks who were not holding degree of Computer Science
  • Trump admin tried to attack H1B extension beyond 3 years but it was not legally feasible so it was dropped out
  • Started H4 EAD removal rule making process after 3 months of office takeover. It went to legal challenge and Trump admin lost in the court. So they started another torturing route, separated H4 and H4EAD from main H1B application and added biometric in H4 so that H4 petition approval delays and H4 holder lose EAD and job. They were successful in this. Several spouses lost job due to this
  • In 2020, S386 bill was about to pass in Senate but Trump sent Senator Rick Scott and he put a hold on that and lifted hold at the end of Dec 2020 so bill still passed but no time left for reconciliation between House and Senate. It was great a opportunity to remove per country cap. Trump admin won.
  • In mid 2020, put travel ban to visitors from India including all visa holders and then corporates came in rescue of H1B/L1 holders and they were allowed to travel.
Apart from these, business was as usual. Overall it is was negative environment for H1B holders.

Green card changes under Trump in first term

Employment based GC processing and changes under Trump rule 2017-2020
 
Here are the changes he did in GC processing after he took over the office.
  • Added I-485 interview which was mandatory for each applicant. This created lot of stress for the applicant specially carrying 500 pages of all the required docs to the USCIS office and make sure you give correct response to each question asked by USCIS officer.
This also created lot of work or called it bureaucracy for USCIS and it slowed down the GC processing. USCIS cut the corners and stopped publishing pending I-485 inventory which was giving clear picture of how many people are waiting in each category and each month. That means only Charlie and USCIS knew how many GC visa are available and how many are allocated. Finally USCIS published again this year in May 2024.
2. Added Public Charge rule in late 2020. This created another confusion among GC applicants whether any benefit they have took from government like unemployment claim using EAD etc. which can cause issue in GC processing.
3. He successfully killed Immigration Reform in 2020 by killing S386 bill which would have eliminated per country cap in employment based visa. The bill passed in House and Senate both but could not get time to reconciliation. This is the first time in last 30 years of US history any immigration bill passed both in House and Senate. Last immigration reform was happened in 1990.

Trump resorted such ateps because he did nit had enough support…

This time, he has support if house and senate. So, rule making will be much better..

india had a lot of weird rules too. 15 days quarantine in some hotels etc. vundindi. was difficult for people working in  gulf countries who were returning home.

Processing delay pakka. WITCH ki jhalak vundochu. C2C ki more RFE. 1 month approvals. Every GC ki interview means 1 year ayyedhi 2 year pattochu. H4 ead finger print back and just 1 year renewals. Many Premium lechi pothai. USCIS staff ki funding ivvaru. H4 peekese chance Miller Dhaya.
