H1b to H4 to H1b question

previously on H1b for 3yrs. Now on H4 wanted to go back to H1b. does my new employer need to file I-129 with USCIS to get my H1b status ?

correct.... employer shd file for I-129 to get ur H1b status back

bro assuming that old h1 petition is expired 

Form 539 file to change your status from H4  -> H1. 
Form 129 for h1b
they will send to gether as per my understanding 

@appaji_pesarattu @akkum_bakkum correct if anything is wrong

why are you taking stress bro attorney ki simple emo ivani 

if by any chance your old h1 is active non expired some people say automatic revalidation entering through mexico/canada might also claim h1 status (i may be wrong consult with attorney)

yes thats correct.... both the forms are needed... I539 is because you are in US and for I129 is to re-activate your h1b with diff employer
