Finally, the rule strengthens program integrity by codifying USCIS’ authority to conduct inspections and impose penalties for failure to comply; requiring that the employer must establish that it has a bona fide position in a specialty occupation available for the worker as of the requested start date;

Requested start date ki job available undali antunnadu. Whether contract, sow, lavada lassun edo oka agreement.

I know emotions are high. But no need for abuse. Chill.

2 big issues. They mentioned the word “contracts” many times. So your approvals be strictly based on these documents. They might go based on the duration of those contracts. So we might witness approvals as less as 6 months. Thanks to musk. All govt agencies are in panic mode. USCIS wants money badly. They will exploit this a lot.

Another biggest concern with this new rule is, It’s the end client that should certify that you belong to speciality occupation. How many clients will be willing to shoulder that responsibility? Think about it.

Specialty Occupation Updates

  • Clarifies that "normally" does not mean "always" when evaluating specialty occupation criteria

  • Allows for a range of qualifying degree fields, as long as each field is directly related to the job duties

  • Defines "directly related" as having a logical connection between the degree/equivalent and position duties

  • Removes references to specific degree titles like "business administration" and "liberal arts"

Program Efficiencies

  • Codifies USCIS deference policy for prior approvals when facts remain unchanged

  • Updates when amended petitions are needed for worksite changes

  • Eliminates itinerary requirements for all H classifications

  • Allows validity period amendments if petition is approvable after initial end date

  • Requires evidence of status maintenance for extensions/amendments

Benefits and Flexibilities

  • Expands cap exemptions for nonprofit/government research organizations by replacing "primarily engaged" with "fundamental activity"

  • Allows cap exemption if beneficiary spends 50%+ time supporting qualifying organization

  • Extends F-1 status and work authorization automatically until April 1st for cap-gap cases

Program Integrity Measures

  • Requires establishing bona fide specialty occupation position exists at start date

  • Codifies USCIS authority to request contracts and conduct site visits

  • Clarifies LCA must properly correspond to petition

  • Adds requirements for legal presence and service of process in U.S.

  • Sets 18-month validity limits for beneficiary-owners' initial petition and first extension

Implementation Timeline

The final rule will take effect 30 days after publication in the Federal Register

Same applies to FT as well unless product based company ? Even then - the client has to prove the role is speciality occupation. Overall ga FT are bit safe.

uscis will argue how  your btech is related to softweare job... they dont care about masters in computer science
