But the power to decide who is an immigrant is very rightfully in the hands of Americans (American politicians elected by Americans).

That's the hypocrisy here. People who are here on visas, somehow conveniently forget the "non-immigrant" nature and then explicitly intend to be a green card holder. 

India is perhaps not on the same level of Pakistan and Bangladesh, both of which are failed states. India is relatively a stable country that's reeling under high inflation and tax pressures.

"Dual intent" is an 'auxillary' component not the primary purpose. Try saying you want to settle down in the USA, when you attend an H1b visa interview for the first time and tell me the outcome.
