Is there a money trail? Cash or check? 

Even if you prove that they took money, police wont do anything. They will listen to everything and say "You should not have given. Be careful going forward"

Small Claims court will be helpful.

Office lo oka desi gaadu vadi House owner (he used to rent a room) GF ki Interest ki money ichadu. Police complaint was useless. Small Claims court konni chivatlu petti, asked the person to payback. However they cannot force someone to pay actually. In his case she paid back.
