If he's dead, then you can't declare him mentally unstable.  If he's alive, I don't think anything is going to happen.

To deny any case on SSR, otherwise they need to file a case as abetment to suicide

How will you declare someone already dead mentally unstable? They need to fabricate elaborate back dated diagnosis. That's will be another Sushanth Singh Rajput case, where a brutal murder was covered up as a suicide.
