I am not saying it is illegal...H-4 EAD was granted via administrative rulemaking of the executive branch. Because it was not directly granted by Congress but rather through DHS, he can probably repeal it via executive order. Obama enacted it via executive action, so it can be cancelled in the same manner....

But they are trying to do it through Supreme Court so that it will not end up in the lower courts and stall it again...

None are saying it's illegal. It doesn't have a legislative backing.

I think SCOTUS attempt is a well planned move. Because, even if Trump admin starts rule making process, people can go to lower courts  and can stall it by getting injunctions. If SCOTUS rules in favour of American tech workers, it will nullify all such attempts once and for all. No other POTUS can come up with another EO. Then the only route would be through legislation.

CPT and OPT are also in line of fire. But these are selling points for MS degrees, which means net inflow of $$. You can't say the same for H4 EAD. They are always replaceable. Removal of H4EAD will be win for Tatah who can project it as a win for bringing jobs back without much effort, as it's a low hanging fruit.  So who knows, it may work out as well.

It would require an act of congress to remove OPT... Because it came into picture with congress law making process in 1990...
