H-1 can be applied at most 6 months in advance of employment start date. Because USCIS fiscal year starts in Oct, USCIS starts accepting petitions in April (6 months prior to earliest start date). This is also the reason why any petition filed in April will have a start date of Oct 2011. U can start ur H1 on Oct 1st or U can keep any Date before ur H1 expies in FEb...I did samething..Apiled in Sep....kept date to start in jan 1st..No problem

it all depends on when u apply for the H1B.. april 1st ki apply chesthey by default 6 months kaabbati Oct 1st..


so aa taruvataa nuvvu filing chesina date nundi 6 months ki define chesukovachu anukuntaa nee start date, depending on ur current visa date.. but once approved.. u can;t travel;..

if u leave the country u need to get the new VISA stamped after approval..

if ur H1 is approved, stamping ki vellali , as ur I-94 is already in teh Records and u cant enter much ahead of October 1st anukunta..

if its rejected, u can come back on the OPT Status.. if ur OPT is valid..

But H1 meeda unna I-94 record change ela avutundhi,. while applying for H1 u will send ur current I-94 kada,, but if u leave the country and enter with a different I-94 from the one used while applying how come USCIS make a chnge of record on the I-94 ???
