[b]No[/b], you cannot transfer your approved h1b petition as you will not change your status to h1b visa till oct'1 2012 (assuming you are on opt ext or cap-gap). Before Oct'1 2012 you have to file a new h1b petition and after Oct'1 2012 you can transfer your h1b visa.

I faced the same situation once.

you file new h1b when you don't have one
transfer h1b means when you have a valid h1b you can change your employer (who has to transfer your existing visa with the petitioner being the new employer)

[/quote] likewise a h1 has already been approved from oct 1st... so h1 transfer doesn't need to wait till oct 1st....

Correst baa....nenu ide paristhiti lo unna...atleast oka pay check run ayyaka u can transfer .....but not until oct 1

If you want this process to happen ur full time Employer should file for New H1(sice quota ayyipoyindhi ganaka) .eppudud all u can do is wait for oct1st and have 1 pay check run with previous employer and then u can intiate a transfer process.but oka sari immigratation layer tho verify chesko...

i got many offers in recent times...h1 approved but didnt start till oct 1...quota over....im in cap gap....all the hr depts, immigration lawyers say the same...

this is true, You cannot transfer your H1b now, when it starts from OCT, you will need to have couple of pay checks from your employer and then can initialize your H1b transfer.

YOU CANNOT START TRANSFER PROCESS NOW
