I would like to share this information which is key to be aware of.

[b]News 1:[/b] Anyone with Masters in Stratford University is not eligible to apply for H1 visa in Masters quota...legally.

[b]Why ???[/b] - Masters degree from stratford doesnot qualify (coz its privately owned and for profit univ) under section 101(a) of Higher Education Act......which is mandatory for applying H1B in Masters quota.

[b]Then How did people get H1B all these years in Masters quota with Stratford Masters??? [/b]
USCIS ignored and now taking this issue seriously. Especially applications (even fresh and extensions) from California Service Center are getting RFE's which may slowly be the same case with Vermont Service Center.

People who got their H1B approved are lucky but may expect issues when they apply for extension. I personally know 2 people who got RFE for their extension

[b]Whats the RFE?[/b]
USCIS is asking that their Masters degree does not qualify for MS quota application but they were approved in previous years, now that they are applying for extension, people are requested to present evidence from school saying that school qualifies under Section 101 (a) of Higher education act which is impossible as the school is for profit and privately owned institution. To be more clear, Stratford must be non-profit or public institution to qualify under section 101(a) which it is not.


[b]What does Stratford say regarding this RFE: [/b]
Stratford agrees with USCIS that students are not allowed to apply in Masters quota H1 as it does not qualify under section 101(a) but can apply under regualy quota.

[b]Good News:[/b]
Students can apply H1b atleast in regular quota and should be able to apply GC in EB2 category with Stratford Masters

[b]Bad News:[/b]

Cannot apply H1 in Masters quota
People who already applied and got approved are expecting issues during extension

[b]Assumptions:[/b]

Looks like people who got stamped in India directly on Stratford University are not experiencing issues.

People who txferred from diff colleges to stratford may expect issues.

Change of Status from different non-immigrant status to F1 and got successfully stamped..... No issues found so far.

No issues found on GC so far but good to be cautious.

[b]Solution[/b]:


Startford Degree ---- Regular Quota H1 --- GC in EB2 with Stratford Masters

Above combination is a no issue strategy LEGALLY. but people who are already experiencing RFE are expecting it to be a 50 -50 chance.

why is USCIS issuing RFE now instead it should have actually done when people applied initially. ??? Good question but no answer.

[b]Whos Fault:[/b]

USCIS for not issuing RFE when these students initially applied fr H1 in Masters quota

College ... If they did not inform students that they should not apply H1 in Masters quota

Students... For not researching about all this.

Complicated things is
" Stratford people who already have an approved H1 under masters has to apply extension in Masters Only.
Attorney mentioned as "THEY CAN NOT APPLY FOR EXTENSION UNDER REGULAR QUOTA "

personally know
1) one guy whose First h1 got denied for applying under Stratford masters
2) 2 Guys from Eastwest Univ,CA whose trasnfer got fu^^ked up.
