H4 To H1 And Lost H1 Approval Notice..

Hello All

 

ma sister 2012 lo H1 apply chesindi ABC company dvara india nunchi, approve ayindi. eelopu marriage ayyi dependent visa meeda stamping cheyinchukuni USA vachindi. She never landed in USA  on H1 or used her H1. ABC company never sent her the approval notice. Approve ayindi ani cheppadu. ma sister daggara I-797C matrame undi inka vere em documents levu. Ippudu thanu job cheyalaukuntundi.. ABC company ni approval kosam adigithe, neku india lo unappdue pampanu na daggara em ledu annadu. But she didnt receive any. Duplciate or scanned copy unte ivvamani adgithe, nee petition withdraw chesanu, nuvvu next cap lo apply cheskomani chepthunnadu.

 

Questions:

 

1. Ipuddu thanu cap dvara vellalsindena?? Cant she reinitiate her old H1?

2. Thanu two days back USCIS ki call chesthe duplicate copy process kosam, your H1 is in approved status- you need to fill form 824 ani chepparu but ABC compay emo petition withdraw chesanu - USCIS will not send any copy since your H1 has been withdrawn antunnadu.

3. USCIS vallemo nee H1 approved status lo undi annaru.. But ABC company chepinatlu withdraw ayi unte how to confirm it??

4. I-797C tho employee transfer pettukodaniki avthunda without approval copy and with just I-797C?

If you have the WAC/EAC number you can transfer H1...Cap exception unda ana question ki ans teliyadu...LTT

Tension vodhu...you can request for approval copy online through USCIS website...Did not receive approval notice option choose chesuko..here is the link:

Get it and I believe you sister will have cap exempted since she already had H1. Good luck brother...

Answers:  

1. Cap excempted. She re initiated the old H1.

2. ABC company ki sambandham lekundane she applied H! without applying for Duplicate copy

3. Her H1 has not been revoked, 

4. Approval notice lekundane H1 apply cheyachu, just with the reciept notice.

 

She filed her H1 last monday in premium without client letter and previous I-797 and she got approval today.
