Contract To Full Time (Help Needed From Db Peddhalu And Pillalu)

One of my friend is working as a contractor and is offered a FT position.  He is not sure if he can accept that position or not since he signed the offer letter from his old company and he read these lines in the offer letter.  Below are the lines,

 

"If you resign or we terminate your employment for any reason with or without cause, then for a period of 90 calendar days immediately following your termination or resignation you agree that you will not own, manage, operate, finance, join, control or participate in the ownership, management, operation, financing or control of, or be connected as an officer, employee, consultant, agent, independent contractor, representative, trustee, stockholder or otherwise with, render advice or services to, have an interest in, or engage in, any Competing Business anywhere in the world."

 

Does the above statement mean that he cannot take the FT position from the client he is presently working now?

he is working for a different position and the position offered (posted externally and everyone encouraged to apply including manager) is a different position...My point is does the statement clearly say that my friend cant accept any position at the client location?

so Basically same company lo different position ki applying?..

 

paina post lo unna rules anni companies ki untaai.. basically company nundi vellipothe competitor company lo or competing business pettanu ani..

 

ee case lo same company but diff position kadha.. ayina y not he once talk wid his HR and sort out thinhs.. :)

same company but different position externally posted,  Manager also suggested to apply but not sure if manager knows about this clause...oka vela maa frnd ee kottha position ki recruit avthe, contract position ni client dissolve chesthundhi...so he is worried for that

Ala direct relationship unte games play cheyyadam very risky. 

Some people go beyond your impagination to screw you up. But that doesn't happen all the time. 

If the current employer has very good relation with the client/customer then they don't step up to screw your friend since that would damage their reputation at the customer as well. 

But the best way to handle is let the client manager initiate the discussion with the employer. If the client manager is willing to help, ask him to say sth like: "Anyway we will not be needing him for the same position. But we are thinking to work with him directly for the other position and there is no possibility for working with external organizations for that position. "

as I understand, mee candidate works through consultant and is offered ft by company

 

ikkada consultant provide chese business hiring/placement. he is not doing engineering projects, right? just a middleman to client. no problem with the language then. FT offering company is not a competing business with consulting company, it's a partner
