Currently my wife is working with X company holding H1 and her job is ending by April 1st, I wanted her to change to h4  just to maintain status my question is:

 

1. Once my employer starts the process for H4 (any immigration is done in premium ) she is eligible to work until her H4 is approved?

 

2. Lets say suppose my employer applies to H4 today and gets approved by March 1st  I believe she has to stop working from march 1st and not today  (can anyone confirm that )?

 

3. Once h4 process in under way and my wife gets job then her new employer applies for h1 transfer how dose this work ? will h4 application will be stopped ?

 

 

Dude.. Read more about last action rule.. IMO, If H4 approved later point (after H1b transfer approval), your wife will be on H4..

1) no premium option for H4 , while your employer has submitted H4 application and is still pending a result, your wife can work for as long as her current H1 doesnt expire
 

2) if H4 applied as of today, and you get I797 saying H4 has been approved starting March 1st (even if H1 is valid till April 1st) , H4 is the new status and its effective right away from match 1st

 

3) while ur employer has applied H4 and its pending approval, meanwhile she finds another job and they apply H1 transfer (i think you may have to inform ur employer to redact their H4 application somehow), considering that and H1 transfer has been applied by new firm, ur wife can keep working well beyond April 1st 

 

tricky thing is what if H1 transfer ends up getting rejected after april 1st?  may be  the new employer can file a motion to reconsider

you mean h4 sill process lo undi if I apply h1 transfer in mean time and h1 gets approved before h4  and later time in 6 months she gets approved for h4  she will be in h4 ? do they not consider  h1 transfer as the latest request and process that ?

1) yes,she  can work until your wife h4 approves,, ne h1 apply chesetapudu thana h4 and ead apply chesthay anni 15 days lo vastahyi

3)yes, if she gets job with another company . your wife  should call to usssciss and ask them to withdraw application .h4 application would be stoppped and h1 transfer can be taken.

did u post this in murthy? I read somewhere that you cannot be on two visa status at the same time...so if uscis is approving one visa then automatically the other gets cancelled..
