Ee month 29th tho 140 EAD comments period complete avthundi. This is one good opportunity to give our comments. 

 

What is this 140 EAD all about:

1. if you are a citizen of any country other than India, China and Mexico and trying to apply for Greencard, you will have the greencard in 6 monts after your labour is approved. But for india, china and mexico it takes atleast 6 years if not a decade in EB2 and over a decade for EB3 category. 

2. Logically as long as you are considered as a high skilled worker, it should not matter from which country you are to get a greencard. But there is a cap on number of greencards that can be granted to each country. As there are lot of high skilled immigrats from india we have to wait till the number are available. 

3. Oobamaa thought that this long wait is not fair ani DOS and USCIS ni asked to review the process and come up with a solution. 

4. Everyone was expecting that they will come up with granting EAD to individuals whose 140 has been approved. (fyi, usually i140 takes around 10 months to get approved including labour)

5. Finally the I140 EAD was posted which has lot of unnecessary clauses like immigrant should be having a compelling reason to apply for EAD, something like severe health problems and cannot work something like this. Which does not make sense.

I know some people may think that they will not consider no matter what, but I think that we should give a try.
