Had the Labor been filed an year ago and still awaiting decision, you are eligible for a 1 year extension. Same is the case with approved labor and 140 in process or not yet filed. Naaku telisina knowledge lo aithe you are not eligible for extension. LadiesTailor Posted May 10, 2016 Report Share Posted May 10, 2016 time to recalculate all your out of country visiting days... if u get it around 1 year then u r eligible for extension.. otherwise hope that u get u r labr apprved by the time u r h1 expires.. if u dont get apprved then u need 2 leave the country... once labr apprved then file for h1 and get stamped... long process.. Experts suggestions please H1b xtension beyond 6 years is based on an approved 140 or perm pending for more than 365 years. In your case either change your visa status to H4 and then apply for EMD based on an approved 140 of your spouse (if your spouse has one) or enroll in a school and change to F1.
