In your case either change your visa status to H4 and then apply for EMD based on an approved 140 of your spouse (if your spouse has one) or enroll in a school and change to F1. Also, speak to your immigration attorney before taking a decision. TS follow these steps. Your labor must be applied before 365 days of 6th h1b expiry. If you get labor certification approval in 6 months or ur 6 yr h1b expiry. Otherwise you have to apply cos to h4 or f1. contine to ur gc & h1b if your employer paying all immigration expensives.
