cos apply cheyacha frm f1 to h4 with pending h1b amendment? or with approved h1b petition...

 

h1b amendment pattu cos apply chesthe....h4/h4 ead effective date start from feb 2017 pettacha?...

As of my knoweledge parent petition tho H4 status ki marchukovachu (2019 lo end avtundhi kadhaa aa petetion use chesi)..Start date ala petta lemdu anukonta naaku telisi..

Yes you can either use your spouse approved h1b and apply your COS and EAD and also request future effective date. or

 

best way is to apply h4-cos and ead by sending approved h1b copy and also h1b amendment receipt copy. If you give h1b amendment receipt number in i539 then USCIS will first adjudicate h1b amendment and then come to i539. My suggestion is do in this way and wait till you get your h4-cos and h4-ead receipt numbers and then upgrade h1b amendment to premium and send all three receipts along with premium check in one package. All three will be processed in 2 weeks. Lot of people did this to avoid long waiting time.
