Bhaiyyas,

My profile:

4 and half years h1b ayyindi (6yrs max), labor approved & I 140 approved too. Sudden ga ma client nannu FT teeskomani pressure peduthundi. As they are merging company etc factors - I love this place too. They will transfer H1B and also file GC it seems

Actual question:

I only have 1 n half year left kada, I have to get my I140 approved by then to go beyond 6yrs h1b. Also, Is there a rule that my priority date changes if old employer cancells our GC process which was applied thru them.

I heard PD date will not change if we take ft and start processing, deep confusion and running out of time. Please help some solution bhayya..

@kiran000

This situation is extremely dangerous - if ur PD is before 2011 then ur risking chance for filing AOS/485 in next 12-18 months.

in case nee client pressure ekkuvaithe  explain the urgency to file PERM within 2-3 months after taking fulltime and risk involved if PERM is delayed due to corp policies, if ur client agrees to file PERM then try to add that clause in ur job offer letter with lead time to file PERM clearly written. Also unforeseen situations like govt shutdown may cause significant delays in PERM processing that can hit you hard by taking more than usual time to reach 140 approval. Ur PD always urs... at the time of filing 140 with the new employer the request for porting ur old PD has to occur.

also nee current employer tho neeku manchi rapport vunte think about explaining this situation and get their blessings  to return to their payroll if something bad happens in future

Hi Bro, I think since you already have approved i140, if your client who is offering FT files H1B using this approved I140(even though its from previous employer) you will get another 1.5 years H1B extension beyond your 6 years H1B(total 3 years from now).In these 3 years you need to get  i140 approved with your client for further H1B extensions
