Is it public traded company listed in the stock exchange? For H1B, it clearly says that H1B sponsorship should be from the company outside, not something in which you are a partner or you are a owner of..so the same thing will apply pretty much for the labor certification. I remember seeing that a few years ago on USCIS site...better check it there..

Why don't you ask immigration attorney. No one says de____y without listening your case. They will give all the requirements. If no one talks for free, take an appointment for couple of hours and pay them.

Any way we are planning to start the same company in USA, in 2 states. After operations started in USA, what if i go back to india for 1 year, work there as director ( anyway being a partner u will be director), come back to USA as Manager, file EB1 GC through US branch.....

 

Is this process matches , qualifies for EB1 ....

that comes under EB5 man, TS is asking abt EB1

neeku workout avuddi man , only thing is apply through a good lawyer , money ekkuva aina kaani it'll be worth it ... apply cheyataniki basic rules unnay le konni , india lo company should be well established and u should be opening a branch of it in the US , iinkaa chaala unnay rules , but if u meet with all of those requirements its very much possible ... most of the db folks that are saying that its not possible have no idea abt what the're talking
