Clinton Effect on H1-B

Few people remember the American Competitiveness in the Twenty First Century Law (AC21) which became effective on October 17th, 2000.

Before this law it used to take 6 months for H1-b transfer to be approved and an employee can start working only after H1-B transfer is completely approved.

Once six years of H1-B is completed one had to live outside United States for One year and apply for H1-B quota again for a Six Year fresh start again.
 
The AC21 law allowed H1-B employees

1. To start working for a new employer with H1-B transfer receipt (full approval not required). 
2. Unlimited 3 year extensions of H1-B after first two stages of green card (Perm and I-140) are approved.
3. Ability to change employers with only new offer letter (no need to inform USCIS) or take promotions to higher positions like project manager or Vice President, 180 days after filing I-485 or third stage of green card.

This law was supported and passed by the most Indian immigrant friendly president Bill Clinton who was rumored to eat Indian food every week.

President Obama is also very Indian friendly as he lived with Indian roommates and ate spicy Indian food. President Obama initially thought of moving jobs back from Bangalore to Buffalo but the Indian curry smell made him change his mind again.

Even though President Bush took a hardliner stance on H1-B immigration initially he softened up in his last years of presidency and wanted to pass numerous laws and memos to help employment based immigration.

However, his drink hour started at 5 PM sharp and he kept postponing his tasks to next day similar to some other rulers of Telugu speaking states before his term ended.

President Obama was a man of words and action. He got the H4 EAD memo passed but got stuck in his own Obamacare insurance problems to take care of other employment based immigration problems like solving extended delay in green cards issuance to Indians due to per country quota. Trump is rumored to be an immigration hardliner and a bland steak and potatoes person.

Hillary Clinton being the loyal wife of Bill Clinton and also known as a very reasonable person is definitely going to take her husband’s advice in passing memos or signing laws which will help highly skilled employment based immigration. However, the US presidency is for 4 years only. There is no guarantee of reelection of US presidency.

It takes 9 months to get PERM approved another 3 months to get I-140 approved. If you are a full time employee of an Indian Implementation partner and still thinking that the company will take care of you will be floating in Hyderabad rain flood roads again.

Your last chance is to get a green card during Hillary Clinton Presidency. She stands an extremely good chance winning the US Presidential election with Trump sniffing, stuttering and stammering in US presidential debates.
