  • The stated goal is to "reform legal immigration to serve the best interests of America and its workers, keeping immigration levels within historic norms." Trump has stated that he would welcome immigrants and support skilled immigration such that immigrants are selected based on their merits, skills and likelihood of success in the U.S. But he has also advocated for prioritizing the hiring of U.S. workers. Mr. Trump criticized the H-1B visa program and would support measures to make hiring H-1B workers even more difficult. It remains to be seen what specific measures and how these measures would actually be implemented.
  • The President-elect seeks to "suspend the issuance of visas to any place where adequate screening cannot occur, until proven and effective vetting mechanisms can be put into place." Such measures may impact applicants for nonimmigrant work visas and permanent residence (including employment-based green card processes), and could also mean suspending immigration from certain countries. Yet, it's also possible that the new administration will not find a need to make many changes once they get a deeper understanding of how much vetting is already conducted in business immigration cases.
  • Mr. Trump has said he will renegotiate or withdraw from key trade agreement such as the North American Free Trade Agreement (NAFTA). Leaving NAFTA would jeopardize the TN visa category for Canadian/Mexican nationals.  We don't expect that those currently in TN status will have that status revoked.

 Timing in which the proposed changes to immigration law may be set in motion:

  • Given the very recent presidential election and the typical pace of change at our federal agencies, foreign nationals in the U.S. should not expect their immigration statuses to be affected anytime soon. Major changes will take time - months, if not years - to complete. The regulations governing U.S. visas are codified as law, and implementing new laws requires substantial time from both the legislative and executive branches of government.
  • With that said, President-elect Trump could unilaterally repeal President Obama's immigration executive actions after January 20, 2017, when he is sworn into office.  The most likely target will be the DACA (deferred action for childhood arrivals) executive action.
