11/11/2016: Reportedly the President-Elect Reconfirm His Intent to Repeal Obama Executive Immigration Action Programs

  • Los Angles Times reports today that "Trump, who met with Obama at the White House on Thursday, also has vowed to overturn many of the president's executive actions on immigration, such as Deferred Action for Childhood Arrivals that temporarily shields from deportation people who were brought to the U.S. illegally as children." It also confirms Kris Kobach's joining in the transition team, which may lead to a hardline policy against immigration.
  • It also has been confirmed by other sources that one of the key members of the transition team which is headed by the Vice President-Elect Pence is Senator Jeff Sessions of Alabama who is known to be a frotier far-right legislator against immigration including not only the undocumented immigrants but also legal immigration system. During the 114th Congress which will end early January 2017, he has been a Chairman of immigration subcommittee of the Senate Judiciary Committee which is headed by Senator Chuck Grassley who has just been reelected for the next six years. There are already a lot of rumors about potential forthcoming change with the employment-based immigration systems, particularly H-1B nonimmigrant system.
  • Obama's Immigration Executive Actions, some of which may be hit hard, include two different types. One is the administrative reforms in the form of rule-making as regulations and the other is the reform in the form of policies and memorandums without legislation or regulation. For instance, traditionally "deferred action" relief from deporation based on the humanitarian concerns has been considered "equitable" relief under the common law that does not need legislation nor regulation. Based on the tradition, Obama Administration implemented this relief under the name of DACA without enacting regulation nor legislation. On the otherhand, there are many administrative reforms under the Obama's Executive Immigration Programs which were implemented by rule-making process and as regulations. Should the President-Elect decide to repeal both of these programs, the impact will be different between the programs in the form of just a policy memorandum such as DACA and the programs in the form of regulations such as H-4 EAD and Expanded STEM OPT programs in that repeal of rules may require a rule-making process, while repeal of policy memorandum would not need any rule-making process. The impact of such drastic actions of the President-Elect would be more imminent and hard for the programs that are implemented without rule-making process.
  • Immigration law community including AILA is currently working hard to develop strategies to fight against such actions of the new government.
