This is partialy true....good example is STEM extension when they veto'ed it they didn't completely cancel the rule they(Court) gave DHS a timeframe to comeup with proper rule making and comment procedure(which they didn't follow when the rule was first introduced in 2008) and then they legalised it....its the same case with all others......everything is binded to a law...like citizenship or visa......

 

word is that he is going to make advanced degree as a preconditon to file h1b..so that will stop this company's filing bulk h1's everyyear....and some amendmets on salaries...so we shud be prepared for changes from DOL too...

Serious and concentrated efforts on H4-EAD rule making started way back in early 2011 (1615-AB92). But it didn’t make much progress during the initial period. The rule was reintroduced in 2012 with the intent of proposed rulemaking to happen in 2013, but it was further delayed and the final comment period ended in July of 2014. USCIS could have released the rule in a few months following the end of comment period but Obama’s executive order in Nov 2014 held it hostage for a while. The rule finally became effective in May 2015, about 4 years after the rulemaking was originally initiated
