What is Deferred Action?

Deferred action is a discretionary decision to postpone someone’s removal from the United States for a certain period of time. Deferred action does not provide lawful status, and it does not excuse any periods of unlawful presence outside of the deferred action period.

Why would I need deferred action? If you are subject to removal and are not eligible for parole in place or a lawful status, deferred action would allow you to stay in the United States for a certain period of time. If your request for deferred action is approved, you:

  • Are considered to be lawfully present in the United States for the period specified; and
  • May apply for a work permit for the specified period if there is financial need (see Form I-765, Application for Employment Authorization).

Am I eligible for deferred action? You may be eligible for deferred action in two-year increments if:

  • You are the spouse, widow(er), parent, son, or daughter of:
    • An active-duty member of the U.S. armed forces;
    • An individual in the Selected Reserve of the Ready Reserve; or
    • A military veteran (whether living or deceased, as long as he or she was not dishonorably discharged) who served in active duty or in the Selected Reserve of the Ready Reserve; or
  • You are an enlistee - or the spouse, parent, son, or daughter of an enlistee - in the Department of Defense Delayed Entry Program (DEP), including through the Military Accessions Vital to the National Interest (MAVNI) program

How do I request deferred action?

  • You will need to provide a letter to your local USCIS office explaining why you are requesting deferred action
  • You will also need to provide copies of documents that show you are eligible for deferred action (do not submit originals). This includes evidence of the family relationship (if applicable), and proof that your relative is or was an active-duty member of the U.S. armed forces or in the Selected Reserve of the Ready Reserve, or that you or your relative is a DEP enlistee
  • For complete details on how to request deferred action, please visit https://www.uscis.gov/military/discretionary-options-military-members-enlistees-and-their-families.

Bro this doesn't really help people who are already in a legal status i.e., F1 and H1B visas waiting to ship to their BCT. This is more helpful for people that have fallen into an illegal status after their student or work visas have expired and currently are in an illegal status.

Also this DA doesn't give them permanent work authorization, it only gives them temporary reprieve from deportation. On Jan 20th, DT could come and override this rule and they all might get deported. So no this isn't helpful for any H1B Army Reserve soldiers waiting to ship.

Lt. Margaret Stock who is the inventor of this program and a lawyer currently based out of Alaska, has clearly encouraged people to continue maintaining their legal visa status in the US and only go for this as a last resort option, in case they lose their legal status.

This is not unrestricted EAD. According to Lt Louis Deli on MAVNI forum, this DA comes with travel restrictions mostly so you can't go out of the US.

yeah that might be true but need to cite a source. Another question is 

If the FS is in status but unable to work, the letter will include most of the above except the letter will address being authorized employment only so he/she can support themselves while waiting to ship.

in status and unable to work ante visa status undi work permit lekunda podam kada, h1b lo full time ki apply cheste teskotledu city lo but there are good opportunities ani letter lo cite cheste they might actually give a ead. Because Devops is in high demand and there is clear deficit of american workers in the same ani oka current graph print chesi source govt data ani petti try cheyandi, you never know until you try or ask them the questions.

Yeah that might work, better to give it a shot. Oka solid lawyer kaavali kaani ee paperwork cheyataniki, Lt Col Stock might be the best but she's very expensive. Have to see if we can find anyone else.
