" The final rule also provides that, once 180 days have passed following the approval of an I-140 petition, the USCIS will not revoke the I-140 petition solely based on the petitioner’s withdrawal of the petition or termination of the business. " - I think the rule is a bit more clear and tight. Also, employer wont think of revoking past 180 days because it affects none. That is sweat shops. Some big firms/vendors revoke h1 and 140 as a policy.

There is lot of difference. 

Past - after 6 year period, you changed employer and old employer revoked your 140 application and let's say before or in between GC process new employer terminates, you are not eligible to extend H1 as you don't have active 140.

now - you don't need to worry as the old application is valid and can extend H1 with employer C. This gives lot of flexibility to move jobs rathering than fearing job loss.

2 weeks back oka uncle tho edey discuss chesha ...athani pd 2008 2012 lo revoke yindhi anta 6 years thavrtha h1 i140 revoke ayina dantho extension appiled anta h1 vachindhi pd kuda retained ...now he is greencard holder...ee rule epati nuncho undhi anta ...but there is some grey area... best part i think is 60 days rule...

Employers can not revoke 140, they can just withdraw -this is FYI..

 

even big orgnizations like J&J did not with draw my i140 because they have to go through lot of legal stuff and this will effect their future GC filing, so no chances of withdrawal and withdrawal is 0.3%. 

 

 

So now still you think there is use of new rule ?

Withdrawn application tho PD retain cheyochu but don't think u can get H1. Anyways good to know. In my case, it helps as my employer withdraw application after leaving and new employer says its risk.
