I understand that you are considering traveling in a couple of days to India.  Please consider this extremely carefully.  There is no guarantee you will be able to return from your trip abroad.  Due to the current climate with the executive order, may people who are outside of the listed banned 7 countries are having trouble re-entering the USA.  CBP is basically re-adjudicating H-1B petitions and sending people back.  There have been accounts of many Indian nationals being turned around.   

 

Do you have a current H-1B visa in your passport?  If not, anyone applying right now for a visa abroad in India are receiving 221(g) for administrative processing.  We cannot tell you how long you will be stuck outside the United States, if you do not have a current H-1B visa in your passport now. 

 

If you do plan on traveling, please ensure that  there have been absolutely no changes to your H-1B since your last filing.  Carry an employment verification letter, along with recent paystubs, and your original I-797 approval notice when returning.   

 

Note that on return, you will likely be subject to lengthy questioning and that everything on your person (your cell phone, computer, and your own person is subject to search on entry).  They have been looking at people’s resume’s on their computers and cell phones  to see if they are consistent with the H-1B information.  So please be aware of these issues.   

 

Again, we do not recommend traveling outside the United States at this time, unless it is absolutely necessary.  It is clear that there is no consistency right now at what is happening at our ports of entry.  I hope that things will become calmer and clearer in the coming weeks, but I understand you have to make a decision on traveling in the next couple of days. 

 

I am sorry that you and many others are having to make a very difficult decisions at this time.  It shouldn’t be like this.
