My frnd is in bad sustain.....let me explain..

current one desi const is holding h1 and working to one big company......

now  that big company wants to take FT and he started FT yesterday itself.....but big cmny didn't file for transfer as of now.they told they ill do on Monday....

but desi cmny yesterday withdrawal h1b (they send documents to uscis).

Big cmny call to desi cmny yesterday for verification ( desi cmny confuse and they thought he already transferred so they withdrawal h1 yesterday... )

 

Wt to do now can any one had this sustain.........no jokes plz advice.......

USCIS usually overlook these gaps. but chala rojulu gap unte kastam

without filing hw can he join and moreover that compy cant hire him without file/without receipt num

fte company h1 file chesi receipt date vaste chalu kada...he can start working?

worst case lo i94 raadu .. he needs to go out and get stamped . 

1 or 2 weeks gap is ok and with new rule , h1 terminate inaka 60 days gap lo he can move to new employer

as far as i know it takes 2-3 months for withdraw . elopu premium lo ttansfer cheskuntey rmkaadu

Empl gaadu Attorney ki send chesi untaadu ga to revoke.. Ask emp to check with Attorney if they already sent out notice to USCIS . Even if he sents out too, withdraw takes like 1-2 M time. So Mostly no issues.

FTE Comp LCA already file cheste not a big issue, ask them to file H1 in Premium immediately. Receipt ravadaaniki 2-3 days patocchu...

Ayina LCA/Receipt raakunda how he started working ?

1 Week gap ala unna kuda usually USCIS overlooks this type of cases

big cmny can take FT and later they can transfer.....its not biscuit story.......think positive.....

Kompadisi Desi const vadiki mandi withdraw cheyaledu kada me vadu FTE tranfer petelopu? 

He needs to apply as soon as possible and get the receipt
