New Bill Proposed that Could Reduce Legal Permanent Immigration By Half!

On February 7, 2017, Senator Tom Cotton and David Perdue, proposed the Reforming American Immigration for Strong Employment Act (herein after “the RAISE Act”).[2] According to the Senators this proposed law “ ..will help raise American workers’ wages by reducing overall immigration by half and rebalancing the system toward employment-based visas and immediate family household members.”[3] Our office has reviewed the proposed Bill and the highlights are as follows:

The RAISE Act proposes:[4]

A. To eliminate preferences for the extended and adult family members of U.S. residents, including:

  • Adult parents of U.S. citizens;
  • Adult siblings of U.S. citizens;
  • Unmarried adult children of U.S. citizens;
  • Married adult children of U.S. citizens; and
  • Unmarried adult children of legal permanent residents.

Yet, it would retain preference categories for spouse and minor children of U.S. citizens and legal permanent residents.

B. To Create Temporary Visa for Parents in Need of Caretaking: For U.S. citizens who wish to bring elderly parents in need of caretaking to the United States, the RAISE Act creates a renewable temporary visa on the condition that the parents are not permitted to work, cannot access public benefits, and must be guaranteed support and health insurance by their sponsoring children.

C. To Eliminate Diversity Visa Lottery: The RAISE Act would eliminate the 50,000 visas allocated to this lottery.

D. To Place a Limit on Permanent Residency for Refugees. The RAISE Act would limit refugees offered permanent residency to 50,000 per year.

Both Senators predict that the RAISE Act would reduce overall immigration by 41% in year number one (1) and 50% by Year 10.[5] At this time, the RAISE Act is merely a proposed legislation.
