Latest Guidance on Enforcement and Border Security Directives

Today, the Department of Homeland Security (DHS) formally released two memoranda relating to the enforcement of immigration laws.  In a fact sheet also published today, DHS clarified a vague provision of one of the memoranda, confirming that foreign nationals with a protected status (we read this to include those with visas and other U.S. immigration status) are not in jeopardy of being placed into proceedings in the event that they have committed a traffic offense or minor criminal violation.  Please consult with an attorney if you have an questions here.  For Pearl clients, see our contact information below.

 

What can you do?

 We continue to recommend that all foreign nationals carry proof of their citizenship and immigration status at all times, especially when traveling within 100 miles of a land or sea border: 

  1. U.S. Permanent Residents:  Carry your green card with you at all times, and keep copies of it in a safe place.  Failure to carry your green card is a misdemeanor. INA Section 264(e).

  2. Everybody:  Take a snapshot on your smartphone of your passport photo page (and other documents, if not a citizen, such as your EAD or I-94 Arrival/Departure card).  Save the photos to your phone's password-protected Favorites folder for easy access.  Additional tips:

·         Keep color copies of your passport ID page and immigration documents in your briefcase or wallet.

·         When within 100 miles of U.S. border, keep originals of the immigration documents with you.

Beware of scams!  Clients have reported receiving phone calls from people posing as government agency officials (IRS, ICE, police), threatening deportation and requesting personal bank account information.  Always say, "I'm represented by counsel," and request their name, number, agency badge number; then hang up and call us.
