Rule is rule ... btw you got it wrong.. its the min.wage.. not the max wage.. and H1B is supposed to be High skilled foreign labor...

It won;t be a random number...100k itself is stopped in First level of House... So the max they can do is pay atleast level 2/3 wage ....so that it's fair for every state.
