USCIS has updated their 2000 memorandum to further clarify minimum requirements for certain computer related positions and applicants who can qualify for such positions on H1B.

This applies to certain computer programmer positions where only an Associate’s Degree (2 year) may not be enough to qualify for H1B. As per regulatory definition of “specialty occupation” requirement for a H1-B, the position must have a minimum entry requirement of a US Bachelor’s or equivalent or higher degree in the specific specialty. It is the responsibility of the employer to establish that the position is a “specialty position” and that the qualifications of the employee meets the requirements of that position.

This memorandum is probably issued to further clarify minimum requirements for H1-B under specially occupation and further restrict H1-B abuse by certain employers.
