ALERT: USCIS CONFIRMS H-1B CAP REACHED:  UNOFFICIALLY FEWER CASES FILED THAN LAST YEAR 

 
U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated H-1B cap for fiscal year (FY) 2018. USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U.S. advanced degree exemption.
 
USCIS will use a computer-generated process, also known as the lottery, to randomly select the petitions needed to meet the caps of 65,000 visas for the general category and 20,000 for the advanced degree exemption.
 
USCIS will first randomly select petitions for the advanced degree exemption. All unselected advanced degree petitions will become part of the random selection process for the 65,000 general cap. The agency will reject and return filing fees for all unselected cap-subject petitions that are not duplicate filings within the upcoming months. 
 
Before running the lottery, USCIS will complete initial intake for all filings received during the filing period, which ended April 7. Due to the high number of petitions, USCIS is not yet able to announce the date it will conduct the random selection process.
 
At a conference in Washington D.C this morning with Donald Neufeld, Associate Director, Service Center Operations, USCIS, X received unofficial information from Mr. Neufeld suggesting that fewer CAP cases were filed than last year.
 
The exact number of filings will be released in the near future. We will provide further information as it becomes available.

Fewer number of applications this year ani gusa gusalu vinipistunayi...

any one want to bet on the total number of applications ? 

I put the figure at 150-160k...

any one who can predict the number of applications closer to the actual number....I will give them $100 GC..!

One trouble spot that arose during the fiscal year 2015 cap season was that the USCIS began to focus on multiple H1B petitions filed by different companies for the same position at the same end-client with the same beneficiary. The USCIS began to carefully review such cases, even in situations where the petitioners were not related to one another, in the legal, corporate sense. While the companies may not have shared any common ownership, the USCIS has determined that such cases can be denied based on the premise that the companies are affiliated by way of acting in concert. In other words, the USCIS can deny such cases based on evidence that the petitioners appeared to have worked together to file the cases in order to increase the odds that a beneficiary would be selected in the lottery. Practically, One applicant can file multiple applications. At the same time, they have to prove the employer-employee relationship. For all the people who have filed multiple applications and if those applications go through the lottery, then they might stumble at the processing stage.

This is a new trend. Law still allows filing multiple applications and regulations will make sure no one will file multiple applications. Law and Regulations are not one at the same. 

So, brace the storm. Many of the rules were confined to rule books but this time, all those are going to be applied as per the book...

 

This is also one of the reasons why they might have essentially meant by 'Duplicate' applications in the notice. They haven't included this term in any of their previous notices for the last few years.

How about law vs morals?

Law allows to get away even after drunk and drive. But a moral person will never do that. What do you make of this?

You dumbfcuk. You don't even remember what you suggested that day. Suggesting to person who is in trouble is one thing. But suggesting to people how to use loopholes is another thing. 

There is big difference between what you said here and what you suggested to all the DBians on that day.

You specifically mentioned -"To all guys who get caught in drunk and drive to follow your process". Nowhere in that thread you mentioned drunk and drive is immoral. Because it clearly violates people  anatomy. 

Well if you are moral, you probably don't fake too. You probably don't suggest people to get away after taking loans. You probably don't cry on others.
