05/07/2017: "State Sponsored Visa Pilot Program Act of 2017" S. 1040 Bill Introduced in the Senate on 05/04/2017

  • This bill was introduced by Sen. Ron Johnson of Wisconsin and co-sponsored by Sen. John McCain of Arizona. The same is scheduled to be introduced shortly in House by Rep. Ken Buck of Colorado. This bill introduces a new nonimmigrant visa of "W"-Nonimmigrant Visa, which will be sponsored by a state government for certain foreign workers who will (1) reside in the State; (2) perform services in the state; (3) provide capital investment; (4) direct the operation of an enterprise, or (5) otherwise contribute to the economic development agenda of the State in a manner developed by the State. Currently, there are two State sponsored programs: One is the State of Colorado and the other is the State of Massachusetts. However, these existing State sponsorship is based on the current H-1B laws and utilize the H-1B Cap Exempt entiries including universities. However, this newly introduced program legislation employers the State government to sponsor and manage the completely new employment-based nonimmigrant visa program of W visa upon approval of such State sponsored W-visa program by the DHS. This W-visa program has many unique features, including, but not limited to, the following:
    • W-visa program is not limited to any specific industries and can be used for many different level of foreign workers with or without professional specialties.
    • W-visa is a three-year visa program just like H-1B and can be renewed on certain conditions and with the approval of the DHS.
    • W-visa is a dual-intent visa just like H-1B or L-1 visas and their immigrant intent cannot affect their nonimmigrant visa status and stay in the United States and for the reasons, they can pursue green card tracks while they work on W visa status.
    • More importantly, certain foreign workers who are otherwise removaable or inadmissible under the current immigration statue can be waivable in most of the exclusion and deportation clauses inasmuch as the foreign worker has been residing in the State on or before 12/31/2016, accepted for the State Sponsored W-Visa Program. Such otherwise inadmissible or deportable foreign workers will concurrently file W-Visa application and application for waiver of inadmissibility/removability to the DHS.
    • Each State Sponor has an annual limit to 5,000 per year which are adjusted by several factors which this bill provides.
    • State will exercise enforcement power for violators, including residing or working in other states by the sponsored foreign worker.
  • In the Comprehensive Immigration Reform bill, S. 744, which Senate passed but failed because of the House's failure to pass it also proposed W-visa program, but the proposed W-visa was limited to unskilled workers and not skilled and professional workers or investment enterpreneurs. This bill, S.1040, is reportedly supported by many stakeholders and political forces and for the next several weeks, this bill is likely to receive a substantial ammount of attension as one of the leading employment-based mmigration reform proposals. This is particularly true considering the limit to current H-1B visa program.

so this is new visa and not yet implmented.
