No use writing in any forums or just signing petitions. I know two ppl from my 
Close circle got gc through eb1c. They are not even qualified. 
With v low marks in bsc n mca , dat person joined in a company in india using fake experience.
Finally he joined CTS and came to USA in 2014. Came here as Senior System Analyst 
And got promoted to PM jus to do eb1c GC. He got his GC last month. 
Many with docs, postdocs, MS are waiting in queue in eb2.

Its our own ppl are cutting our own head. Fraud has become an intergral part of Cognizant.

While it’s true that EB-1C is prone to abuse, most of that abuse is by corporations, not by individuals. That is, it’s not the individuals who are abusing it. Rather, corporations who have both US and Indian offices will create sinecure “management” positions at an Indian office, assign some favored friend of the company’s ownership or management to that position, and then, after they’ve established the required “experience”, transfer them to the United States under EB-1C. The people who get to use this shortcut pathway are largely well-connected, politically or financially influential people in India. Those who lack such connections understandably feel put out when a corrupt scheme like this is used to allow someone whose only qualifications seem to be knowing the right people gets to skip ahead of the literally millions of other Indians who are hoping to ride the slow and risky H-1B to EB-2/EB-3 pipeline to US citizenship.

I don’t know to what extent EB-1C applicants actually commit fraud; while the policies for EB-1C do set for a definition of “executive or managerial”, it’s not that hard for someone to meet these criteria with even minimal qualifications; all the person has to do is “manage an essential function” for a year. You were in charge of restocking the bathrooms for a year? Congratulations, you’re qualified to immigrate to the United States as a manager!

I honestly don’t know what Congress had in mind for EB-1C when they created it; presumably, it was intended to allow multinationals to freely move their managers and executives from country to country as needed, relatively unhampered by immigration processes. Congress tends to give corporations what they want. That said, I am aware of at least one multinational consultancy (with an Irish home office) that used to maintain a number of “managers without portfolio” who are probably in the US on EB-1C. This same consultancy has a surprisingly large number of L-1 and H-3 admittees, as well as a very large number of H-1Bs.

Since the main beneficiaries of this law are large corporations (it gives them access to a thing of value that they can give out to pretty much whoever they want, and in exchange get people who are beholden to them, all at very little cost to them), and the people who get to shortcut the immigration process through this form of abuse are typically closely-connected insiders of these corporations, it’s unlikely that Congress (which now more than ever is controlled by corporate interests) will change the law any time soon.
