Babri Masjid Demolition Case: A CBI court in Lucknow today granted bail to all accused, including BJP stalwarts Murli Manohar Joshi, LK Advani and Union Minister Uma Bharti, in connection with Babri Masjid demolition case.

LUCKNOW: A CBI court on Tuesday charged+ former deputy PM LK Adavni, senior BJP leader MM Joshi and cabinet minister Uma Bharati for their role in conspiracy behind the demolition of Babri Masjid in Ayodhya in 1992. They all, however, were allowed bail on personal bonds of Rs 50,000 each.

As the court proceeding started on Tuesday, the counsel for the 12 accused moved a bail application on behalf of Advani and others, which the court allowed. Thereafter, they moved another application, pleading their discharge from conspiracy charges, which was rejected by the CBI judge. Now, an additional section of 120 B of the IPC (criminal conspiracy) has been invoked against them.

Apart from Advani, Joshi and Bharati, other accused who appeared before the CBI court included BJP MP Vinay Katiyar, Sadhvi Ritambara, Vishnu Hari Dalmiya, Ramjanmabhoomi Trust chief Nritya Gopal Das, Ram Vilas Vedanti, Baikunth Lal Sharma alias Prem Ji, Champat Rai Bansal, Dharma Das and Satish Pradhan.

All of them were named in an FIR filed after the demolition of Babri Masjid on December 6, 1992 for allegedly instigating the mob and conspiracy behind the razing of the disputed structure.

They were booked in a separate FIR while the main FIR had been lodged against the lakhs of karsewaks for demolishing the structure. The trial of saffron leaders started at a special court in Rae Bareli while the karsewaks were being tried before a Lucknow court. The CBI court however dropped the conspiracy charges against these saffron leaders in 2001 and the Allahabad high court upheld the judgment in 2010.

But the Supreme Court on April 19, 2017 revived the conspiracy charges and and shifted their case from the Rae Bareli court to Lucknow court along with other accused who had been booked for the actual demolition of Babri Masjid.

The apex court also directed the special CBI court to frame charges within a month from the date of production of the order before it. Hence, the CBI court is in a hurry to frame the charges and start trial on day-to-day basis in compliance of the SC direction to conclude trail in two years.

 

The court could not frame charges on earlier occasions as all the accused were not present before it. Directing the accused to appear in the court on May 30 for framing of charges, the special judge SK Yadav had cautioned the above accused that no further adjournment or exemption from personal appearance would be granted.

On Tuesday morning, when Advani and Joshi came together to the city from Delhi, there was a beeline of saffron leaders to meet them. While deputy CM Keshav Maurya and cabinet ministers SP Sahi and Ashutosh Tandon reached Amausi airport to receive them, CM Aditya Nath Yogi met them at the VVIP guest house where they had a brief stopover before proceeding towards the CBI court in Indiranagar.

2:35 pm: The court, which is hearing two separate cases relating to the demolition of the 16th-century mosque, had granted bail to Mahant Nritya Gopal Das, Mahant Ram Vilas Vedanti, Baikunth Lal Sharma alias Prem Ji, Champat Rai Bansal, Mahant Dharma Das and Satish Pradhan earlier this month in the second matter.

2:20 pm: All the accused appeared before the court for framing of charges in the light of a Supreme Court order restoring the serious offence of criminal conspiracy against them.

2:00 pm: Bail was also granted to BJP leader Vinay Katiyar, VHP’s Vishnu Hari Dalmia and one-time Hindutva firebrand Sadhvi Ritambara, who also presented themselves before the court today.

1:43 pm: The Supreme Court had called the destruction of the mosque a “crime” which shook the “secular fabric of the Constitution” while allowing the CBI’s plea seeking restoration of criminal conspiracy charge against the four BJP leaders.

1:40: All the accused have filed discharge plea, say TV reports.

1:38 pm: The CBI court will frame charges shortly, according to reports.

1:30 pm: BJP leaders got bail on Rs 20,000 personal bond, according to reports.

1:28 pm: The charges were minimal and no need for Uma Bharti to resign, BJP Subramanian Swamy told CNN News18.

1:20 pm: In a relief for senior BJP leaders, all accused including LK Advani, Murli Manohar Joshi and Uma Bharti were granted bail by the CBI court in Lucknow.

1:06 pm: However, the Supreme Court had said BJP leader Kalyan Singh, who is the Rajasthan Governor and during whose tenure as the chief minister of Uttar Pradesh the disputed structure was razed, is entitled to immunity under the Constitution as long as he holds the gubernatorial office.

1:01 pm: The top court had called the destruction of the medieval-era monument a “crime” which shook the “secular fabric of the Constitution” while allowing the CBI’s plea seeking restoration of criminal conspiracy charge against the four BJP leaders, including Katiyar (62), and others.

12:45 pm: BJP MP Sakshi Maharaj today said “no power on earth” could stop the construction of a Ram temple in Ayodhya ahead of proceedings in the 1992 Babri Masjid demolition case. The Babri Masjid versus Ram temple debate should be dropped now, he said, claiming that those who had opposed the construction of the temple were now Ram bhakts.

12:40 pm: The Muslim community too was in favour of a temple being built in Ayodhya, he told mediapersons. “No power on earth will be able to stop the construction of a grand Ram temple in Ayodhya,” he said.

12:30 pm: Meanwhile, senior Hindutva leader Ram Vilas Vedanti, an accused in the case, said that he was among those who had pulled down the structure in Ayodhya. “I was one of those who had pulled down the dome of the disputed structure in Ayodhya,” Vedanti, who is here to appear before the special court in the Ayodhya case, told reporters.

12:17 pm: The apex court had also directed the trial court in Lucknow to commence the proceedings in four weeks and hear the matter on a day-to-day basis so as to complete the hearing in two years. The apex court also said there will be no ‘de novo’ (fresh) trial. The CBI has been ordered to ensure that at least one prosecution witness appears in the trial court for recording of testimony.

12:10 pm: The Supreme Court also ordered day-to-day trial to be concluded in two years. The apex court ordered that two separate cases in Lucknow and Raebareli against Advani, Joshi and Bharti and unknown ‘kar sevaks’ shall be brought together in one trial.

12:04 pm: The chief minister welcomed Advani with a bouquet of flowers as the former deputy prime minister stopped at the VVIP guest house before leaving for the special court.Yogi Adityanath was waiting at the guest house for Advani along with other state leaders. Later, the chief minister held a meeting with Advani and other senior leaders.
