Women Use The Law As A Weapon For Vengeance,” Observes High Court Judge, Pratibha Rani

It’s possible for people do things in anger. I believe that. Cities, innocent lives and oldest of relations get destroyed in anger. Had anger, insecurities, or rage not been the part of the universe we lived in, the wars wouldn’t have happened, partitions wouldn’t have happened, bombs would never have happened. Don’t you think?

In an observation, a a Woman Delhi High Court judge finds that more than betrayal, feeling of getting retaliation is making women use law as a weapon.

How? Well, many women label a healthy consensual act of physical intimacy, into a rape, out of frustration. According to a Bar and Bench report, the single Judge bench of Justice, Pratibha Rani said, 

There (are a) number of cases where both persons, out of their own will and choice, develop consensual physical relationship, when the relationship breaks due to some reason, the women use the law as a weapon for vengeance and personal vendetta.

They tend to convert such consensual acts as an incident of rape may be out of anger and frustration thereby defeating the very purpose of the provision. This requires a clear demarcation between the rape and consensual sex especially in the case where complaint is that consent was given on promise to marry.”

The recent observation was made by the judge when this case came to light. In this particular case, a woman filed an FIR against her husband, under the sections 328 and 376 (attempt to rape and murder) of the Indian Penal Code.

But in the testimony before the trial court, she said that she lodged the complaint because of a “misunderstanding”. She asked the court to acquit the man as she is happily living with him, again. She said,

“I know the accused since March, 2013 through Facebook. We became friends for one month and then developed love. Thereafter, we started a live in relationship. Now I got married with him on 29.11.15…

The physical relations were made with the accused with my own consent. I do not want to pursue with the present case as I am living happily with the accused. I pray that the accused may be acquitted as he is innocent and did not commit any offence against me.”

As there was no evidence of rape that was provided by the woman, the court decided to acquit the man.

 

Later, she approached the High Court and said that she was forced by her husband to say such things before the high court. But high court decided to dismiss the case saying that the woman was a mature lady of 27 years of age when she filed the FIR.

Which means when they married in November, the girl must be of around 25 years of age and was in a consensual relation. The court said,

“The petitioner in this case is a matured lady who was aged about 27 years at the time of registration of FIR. She was having friendly relations with the respondent No.2 since the year 2013 and as per the FIR she had given consent to have physical intimacy on the promise of respondent No.2 to marry her…”

The judgment also said that now she cannot claim that the husband misled her to make a statement before the court.

Well, we don’t know what happened between the two, but people need to realise that the law has been made to serve its people. Women who have been raped, assaulted, and harassed would not find a place in the eye of the law, if other women of the society ‘fake’ it to get revenge.

Beware of sexual relationships with desi women, they will take you to court and make sure you are thrown in jail if things go wrong.

Law will take its own course.

Can't declare anyone as innocent, based on gender.

If a woman complains, it should be taken seriously. end of story.

Let a man complain no. It'll also be taken seriously.

Obviously you haven't read the article at all.

It's the high court judge who said in there that some men are being victimized with these false complaints.

Also given example is of a woman who lodged a complaint and then withdrew, again all this fairly obvious to someone who has read the article not to those that have no clue about what they are saying.

I don't have to read the article. I can spot bullshit just from the headline. Its not a fcuking research paper.

Judge who tried to preach to the society based on a few cases is an asshole. Anyway Indian judges have made funnier statements than this. They don't know when to keep their mouth shut.
