”If there is a will then there is a way” holds good for most cases But I don’t think it applies in case of start ups while holding aH1b, you have to be a sleeping partner with zero monetary returns( legally) of course you can be an investor that’s a different thing. If that is the intention then yes you can be a partner.

Unless you have millions of dollars to invest, H1B isn't a feasible model to invest or be a partner in a start up for the most part. Exceptions exist but those are exceptions, plus with the current wait time being >30 years or so it's impossible for anyone to be a partner in a firm and yet focus on his day to day employment for a paycheck. 

There's a reason why very few to zero people on H1B are in a position to take such risks, it's just not a model that's conducive to an employer dependent employee on H1B.

Such things look good on paper when it comes to actual reality, where there is a will there's a way doesn't necessarily translate into action all the time. In facts translates very very rarely.

Even among us, I am sure there are a few smart people who can make a difference in terms of joining a start up and make it succeed but due to our visa situation, we won't even get a chance to try it. By the time we end up getting a GC, we will be too old and lost our youth. 

I understand people saying if you really smart GC or without GC won’t matter but I think that is true if you are really really super smart or IIT/IIM with added luck GC won’t matter. But I am with you it will make a difference to larger crowd some of them who are interested to start up a company or do some independent work and take some risk to loose your investment but the bigger thing here is maintain the status if so  EOD you will be in big soup.

Bro IIT/IIM doesn't matter, even if it does it only matters to a little extent. Beyond what they "teach" at such institutions, the reason a lot of people from those institutions end up being successful is primarily because of the support system that's built around people that graduate from those institutions. The power and strength of the alumni network matters a great deal in such cases. 

Now coming to being an entrepreneur on H1B, what people fail to understand is that even the most successful entrepreneurs that you see today are ones that started out with numerous failures, read about Elon Musk himself. You can take such a risk if you have a permanent residency in the nation where you are trying to do that, since you can go back to the drawing board and figure out what went wrong. 90% all startups invariably fail, a truly successful entrepreneur isn't someone that never fails he's someone that learns from his failures. 

But if you are an entrepreneur on H1B, if you fail which you mostly would you end up getting kicked out from this nation. Tell me why would anyone undertake such a huge risk with the rate of 90% failure only to get booted from this nation. Of course they wouldn't, that's the plight of the H1B worker.

Mine was an observation not a complaint. It's time you learn to differentiate between the two.

my friend has a company in india and has some sort of operation in US.....you need to take a risk 

and you can start a business even on H1.....FYI

That's a different model then, since he has his base setup in India. I am talking about those that want to start their business venture in the US on H1B. Yes you can start a business, you can't actively run it though as you can only invest in it passively, plus you can't get paid by that company. Defeats the entire purpose of starting your own venture. 

India lo business start cheyalante you need to have political and business connections, caste affiliations, mafia support etc. India is among the worst nations in the world to start a business btw. Ranks 130, even some sub saharan African nations rank above India.
