You cant apply H4ead based on I140 you have in past which has been revoked. But you can apply h4-ead based on AC21(which mean you spouse has h1b more than 6 years). Ac21 tho USCIS vadu konni documents aduguthadu like labour whould be applied before 365 days of h1b last year etc etc..check online forums
