this is what happened to my friend. My friend got divorce with out going to india ( in a indirect way)

His wife filed a divorce case in court based on desertion ( both planned to go this way). Court sent notice to my friend.

He received the notice and deliberately didn't attend the  court hearings , finally court gave judgement in favor of his wife. 

After getting the divorce, he went to india ,remarried and came back to USA.

IF it's mutual consent and both have contested in USA then divorce is valid in India too Ade iddarlo okalu contest cheyakapoyna that divorce is invalid in India 

more over divorce case is independent of dv and 498a
