03/13.2019: DHS Reportedly Seeks Delay of Filing Report in H-4 EAD Lawsuit Until 04/01/2019

  • USCIS initiated a rule-making process to repeal H-4 EAD program by submitting its proposed rule, but OMB has yet to clear this and the USCIS has yet to publish its proposed rule in the federal register. Pending that, the DHS asked the court in the pending litigation to give it a time until April 1 to submit report, according to the report of Redbus2US. We have to yet to review the motion, but out interest is to learn the cause behind the DHS motion of delay. Would it mean that the USCIS may complete the "proposed rule" maing process with the OMB by the end of March? We will wat and seel. Stay tuned.

March 12th, 2019(Official ) : On the lawsuit side, DHS has requested Court to extend their date by 14 days due to pre-planned court hearing travels, leave. They have asked the new date to be April 1st. Court is yet to respond to the request. See below for the official info on the documents submitted. You can check H4 EAD Lawsuit Court Documents History  for actual documents.  On the rule making side, nothing has changed and the rule info is submitted to OMB ( Office of Management and Budget) and they are reviewing the same.  If court approves, we may not hear anything until April. We need to wait and see, if court will give the extension…Stay tuned for updates.
