Did TCS steal data? Firm fights a US charge

Epic systems software provides healthcare apps (billing, ER, etc). It is like SAP/OracleApps in terms of customization. Epic systems don't allow people to sit for their certifications the way SAP does. Basically, to become Epic certified, your employer (like Kaiser Permanent) have to sponsor your cert. Only the clients that have implemented Epic can send candidates for certification.

Anyway, do you guys remember Oracle's lawsuit against SAP, which bought TomorrowNow, which used to support Peoplesoft app.  The current lawsuit against TCS by Epicsystems is similar to Oracle's lawsuit against TomorrowNow, which SAP bought. When Oracle purchased Peoplesoft, bunch of consultants started TomorrowNow to support then existing Peoplesoft implementations without going through Oracle. However, TomorrowNow downloaded all support documents from Peoplesoft website (think of downloading all Oracle Metalink documents using UPS support contract).

In this case, TCS downloaded all (or abnormal number of) technical support documents from the Epic systems support portal--using Kaiser Permanente's credentials since Kaiser wh0red out itself to TCS for cheap offshoring. Now Epic systems is going after TCS.

SAP paid $272M to Oracle for a similar blunder. Expect TCS to pay that much.

I think these idiots downloaded all documents, because it is very hard to get into the EPIC space, as Epic doesn't permit certifications/trainings to those who have not bought the software. Smart folks at TCS downloaded and kept them in order to start a new EPIC practice in America.

I read the article.  TCS won't go bankrupt, its market cap is $100B. Just they are trying to see which arguments are going to work. In the best case, appeals court will order a new trial. I don't think it will happen:

Quote

It said a TCS employee reviewed Epic's intellectual property under the pretence of doing consulting work for Kaiser Permanente, the largest managed health care company in the U.S, and in doing so downloaded Epic's proprietary software to help build a rival system.TCS maintained in its statement that it did not misuse or benefit from any of the said information for development of "Med Mantra' which it implemented for Apollo Hospitals in India in 2009.According to Epic, Kaiser Permanente had contracted it to handle its patient records in 2003.In 2005, TCS employees requested access to the company's sensitive internal web under the guise of being Kaiser Permanente employees in need of training.Kaiser confirmed to Epic that the consultants were working for it, whereupon Epic had the workers sign a privacy contract to keep the inner workings of its software secret. But Epic alleges that TCS contractors accessed Epic's internal network to download the entire suite to help TCS build a competing product called Med Mantra.
