DHS Says H4 EAD does not affect US workers

H4 EAD news update today: DHS informed Federal court on Apr 1, 2019 that H4 EAD program does not affect job competition in US job market!

This is good news for 100k H4 EAD workers and holders as DHS has not found H4 EAD’s negative impact to American workers in their economic impact study! This could be a big blow to SaveJobsUSA argument and lawsuit’s basic premise.

The acceptance that H4 EAD does not affect jobs is a win for H1B spouses and might be a hint that DHS may have something good for H4 EAD in their kitty. Only time will tell.

Next SaveJobsUSA vs DHS court date hearing is on April 8, 2019 when immigrationVoice will present their argument in favor of H4EAD.

This is DHS’ strategy to get the lawsuit dismissed rather than arguing anything about the merits of the H-4 EAD itself. If they get the lawsuit tossed or not, they still plan to eliminate the H-4 EAD.

H-1B Spouses’ Work Permits Don’t Harm American Jobs, DHS Says

  • Agency to propose ending work permit program
  • Says court shouldn’t decide issue of authority to issue regulation

An Obama administration regulation granting work permits to the spouses of certain H-1B workers doesn’t directly increase job competition for U.S. workers in the tech industry, the Homeland Security Department says.

The agency made the argument to a federal appeals court in Washington in an attempt to get a lawsuit over the regulation thrown out for good. More than two years ago, a lower court said the U.S. workers who brought the case couldn’t show that the regulation harmed them...
