@Merabharathmahan bhaya ki case sariga artham kaledu anukunta  see below

he has visa stamped h1 b 797 lo unna date varaku, that is 2020 some sep, but his indian passport has or had an expiration date feb 2019. so port of entry lo ofc will give online i94 untill passport exp date regardless of ur visa stamp with multiple entry option. there is flag box will get he can't overide that passport exp. so he gave until feb 2019 i 94 which is now expired last month.

ikkada clear case he knows that, he is out of status. but dude after renwaal of his pass port contacted POE, at least 1 or 2 days before contact chesina it woukd have extended to 2020... so even if you go on march 1st also ur considered illigal presence.... better kaka nuvu non pro trunc gurunchi google cheyu, so i know these things murthy lo chudu ... i94 expire ani kottu kuppal kuppalu untai ... all the best 

best thing there are so many people without knoweldge of this in this sitution... so ikkada we are passibg info not thretening

Ippudu poe lo feb end varaku i94 expiration unna, if he applied for h1b ext after coming from india and got approval till sep 2020, then he is not out of status as his i94 on h1b approval notice will be the latest one....

 

isnt that case valid in this scenario also even though his passport expired.

edi chala lengthy topic, even most of the employeds also have dual stands on this.

first thing  POE and uscis data bases are not in sync, according to POE i94 is expired.

and according to USCIS it is valid and i 94 not expired....

now only these cases cmg up from last 3 yrs nuchi .... so talk to good immu lawyer....

my opinion ext kuda not valid according to POE he has to go stamping after ext ... taht is der arug...or rule 

so let us know what ever happens to ur scinario so other dbians will be aware of that...

chalavaraku andaru 5-6 years varaku india vellaru, so valla last poe i-94 eppudo expiry avtadi and they are in usa based on the latest i-94 in their visa apprval notice 

 

so in my opinion, TS situation enti ante his poe i-94 is the latest one and he got it till the passport expiration but not till visa end date... so in this case he is out of status ... not sure how he can re-intiate his visa status

Stamping doesnt matter for i94. When you entered into USA after stamping normally officer will give i94 to match with our passport expiry or h1b visa which ever expires first. If passport expires with valid visa or extension, then you need to get new passport and get new i94 from CBP office or by reentry in your nearest border. In your case, your i94 is already expired, so you are officially out of status. Go back to India and come back again in next flight to be safe and explain the situation to immigration officer at POE.

no goback india , it will be problem.... apply non pro trunc ...(ntp) 4k karvhu avuthadi ... it will overrides ur i94 and reintiates Premium lo ayithadi... most of immu lawyers knows this

what ever u can do it do  by staying .in US dont go untill ur lawyer says..
