Why Green Card dates are not moving in India EB2&EB3 lines?

Hello Green Card backlogs on H-1B, you all have this question at one point of time. If not at least know this truth in simple way of explanation.

Question is why EB2&EB3 GC dates in employment based are not moving? Especially EB2 India priority date moved just 5 days in last 5 years. Means from FY2014-FY2019 EB2 India priority date moved 5 days.(Source: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html)

Before answering that question we all should know that DOS-Department of state issue Green Card. So, DOS does AOS from I485-EAD to Green Card.

USCIS-United States Custom & Immigration Services processes Green Card applications through I485 from i140 to EAD.

So, these are the waiting numbers as of November-2018 waiting for Green Card with I-485 EAD as of November-2018.👇

*So, using Tollbooth concept let me explain Green Card waiting times to EB2&EB3 India applicants.*

These small numbers are waiting at dos toll booth. Only lets out 2,800 per year. 

The toll before reaching dos booth is maintained by uscis. Assume the distance between two is 5 miles.

Due to 7% country quota the roads between dos tollbooth and uscis tollbooth completely filled and the traffic line is past uscis tollbooth on Highway EB2&EB3 India GC line.😊

So, now tell me dates move?

DOS tollbooth moves dates only when they feel they don’t see enough traffic between DOS tollbooth and uscis tollbooth.
Whenever dos tollbooth moves dates, uscis tollbooth asks new applicants to apply and then uscis process applications and lets those applicants move over uscis tollbooth.


The number of Indian applicants with i140 approved and waiting for uscis signal are stretched over 1000 miles from uscis tollbooth to fit into 5miles stretch between dos tollbooth and uscis tollbooth.😁

5 miles stretch between dos tollbooth and uscis tollbooth is completely occupied by i485-EADs on roads as well as even on curbs and waiting to get passed over dos tollbooth to get GC. So, to clear people on roads and put people on curbs on roads dos won’t move their dates because 2,800 per year per EB line country quota bottle neck.

Hence, dates are stuck in 2009 and not going to move beyond May-01-2010 deadlock date sooner. Fact is that EB2 date moved 5 days in last 5 years because 5 miles stretch between dos tollbooth and uscis tollbooth is pretty congested.😊


*DOS tollbooth gives GC ticket and uscis tollbooth gives I-485 EAD ticket.*


Those small numbers you are seeing is with I-485 EAD uscis ticket waiting to Passover DOS tollbooth. Unfortunately due to country quota dos tollbooth don’t let more than 7% go beyond dos tollbooth to give GC even the 5 miles stretch congested and traffic struck stretched over 1000 miles.

So, whatever numbers you are seeing in DOS report is right and those numbers are maintained by dos tollbooth.


By the way uscis tollbooth never counts how many occupants in each car. Simply gives I-485 EADs to all occupants in car if primary applicant is eligible. Where’s dos tollbooth counts every occupant in car and counted against 7% country quota that is 2,800 per EB line per year before it let go through dos tollbooth.

Hence, 150 years waiting time is real. And it’s not fair to put unlimited waiting times for India EB2&EB3 applicants due to arbitrary 7% country quota.👇

Solution to fix India EB2&EB3 GC line is S.386-Fairness for High Skilled Immigrants act of 2019. So, talk/meet with your state US Senators to pass this bill sooner than later and show fairness in GC allocation.
