NEW DELHI: 

Ram Jethmalani, one of India's finest lawyers and a former union minister, died this morning at his home in Delhi. He was 95.

The legal veteran died at 7:45 am at his official residence in New Delhi, his son Mahesh Jethmalani told news agency PTI. Ram Jethmalani had not been keeping well for the last few months, his son said.

Mr Jethmalani, a six-time Rajya Sabha member, served as a Union Mnister in the United Front and NDA governments. He joined the BJP-led NDA ministry in 1998 and then again in October 1999. However, he quit the Atal Bihari Vajpayee government in July 2000.

Mr Jethmalani had also served as the chairman of the Bar Council of India.

He had obtained a law degree when he was just 17 and started practising law in Karachi until the partition, says his official website. "The partition led him to move to Bombay as a refugee and he began his life afresh with his family," it says.

He is a defense lawyer and it is his profession to present his client side of the arguments, right or wrong is for the judiciary/judge to decide

‘Old Man’ Departs from God's ‘Waiting Lounge’: Remembering Ram Jethmalani

Jethmalani was unpredictable in his choice of cases. He defended several criminals to save them from the gallows, but argued in favour of the death penalty. He spoke out against corruption and also defended high-profile personalities in corruption cases.

New Delhi: "I am now an old man living in God's waiting lounge”. This is how veteran lawyer Ram Jethmalani would often refer to himself in his last spell as an officer of the court.

Days before his 94th birthday in 2017, Jethmalani had hung his boots after more than seven decades of exemplary career in practising law.

 
 
 

When he showed up at a felicitation ceremony to welcome the newly appointed Chief Justice Dipak Misra, Jethmalani made the formal announcement: "My lord, I am appearing before you for one last time. I am more than 90 now. I have seen it all. I am now just an old man living in the God's waiting lounge."

The doyen of criminal law had then said that people, whom he had seen as children, have become judges and now the Chief Justice.

Jethmalani declared that his house was always open to young lawyers, who wished to learn.

"It is not a bed of roses. Sometimes, there is a bed but no roses and other times there are roses but no bed," the ace lawyer told the budding advocates. Justice Misra wished him well, and said Jethmalani still had a lot to offer to the world of law and that someone like him can never retire.

Jethmalani was a Partition refugee who went on to become one of the greatest lawyers of the country.

He was a lawyer to activists, politicians, detenues, murderers, dacoits — all without discrimination.

If he strategised the famed KM Nanavati case, he also represented the assassins of Indira Gandhi; if he fought against the black money menace, he appeared for Lalu Prasad Yadav in the fodder scam cases.

Jethmalani was unpredictable in his choice of cases. He defended several criminals to save them from the gallows, but argued strongly in favour of the death penalty. He spoke out against corruption and also appeared for a string of high-profile personalities to defend them in corruption cases.

Likewise, Jethmalani's political career, too, has had many flavours. Apart from Atal Bihari Vajpayee, in whose cabinet he served as a minister, the lawyer was critical of most of the politicians and blamed them for the state of nation.

Following a series of letters and adverse statements, the BJP chose to end its association with Jethmalani in 2013. But that never deterred Jethmalani from talking about relevant political issues, and the need to end corruption in all forms from high public offices.

Jethmalani was an avid badminton player, and was known for his flamboyance. He would often talk about love and life, would out-dance and outtalk everyone in a party till some years back.

September 8, 2019 is the day Jethmalani departed from God's Waiting Lounge.

Eminent Supreme Court lawyer and former union minister Ram Jethmalani passed away on September 8.

Jethmalani had served as a union minister for law and urban development in the Atal Bihari Vajpayee Cabinet. He was also the chairman of the Bar Council of India. He had announced his retirement in September 2017.

He had fought several high-profile cases and had represented controversial clients.

 

Here are some of the key cases that Jethmalani fought over the course of his long career:

Nanavati case 

By his own admission, Jethmalani came into the spotlight when he appeared for the prosecution in the famous KM Nanavati vs the State of Maharashtra case in 1959. Nanavati, an Indian Navy Commander, was tried for the murder of his wife's lover, Prem Ahuja.

According to reports, while Jethmalani did not have direct involvement in the case, he assisted public prosecutor CM Trivedi, and later YV Chandrachud, the public pleader in High Court.

Indira Gandhi assassination case 

Jethmalani served as a senior counsel for Satwant Singh and Kehar Singh, who had been convicted for assassinating former Prime Minister Indira Gandhi.

An India Today issue from 1988, when the apex court stayed the execution of the two convicts, suggests that it was Jethmalani's strategy that had managed to save Satwant and Kehar. They were subsequently hanged till death in January 1989.

Rajiv Gandhi assassination case

Another prominent -- and controversial -- case that Jethmalani took up was defending former prime minister Rajiv Gandhi's assassination convict, V Sriharan.

Jethmalani had courted controversy in 2015 when he said that the bomb attack that killed Gandhi was not a crime against India.

Harshad Mehta case

Among the battery of senior lawyers that Harshad Mehta -- the stockbroker who was reportedly the kingpin of the 1992 stock market scandal -- hired was Jethmalani.

Jethmalani defended Mehta and Ketan Parekh in the 70-odd criminal cases lodged against the Mehta family, according to a report by The Economic Times.

2G spectrum case 

Jethmalani represented Kanimozhi, a senior Dravida Munnetra Kazhagam (DMK) leader, a Member of Parliament (MP) and the daughter of former Tamil Nadu chief minister M Karunanidhi in the 2G spectrum case.

Jethmalani had then said that Kanimozhi was being targeted because she is Karunanidhi's daughter.

Hawala scam case 

Jethmalani appeared for senior Bharatiya Janata Party (BJP) leader LK Advani in the Hawala scam case, in which politicians allegedly made payments in black money through hawala brokers.

Jethmalani had later said that Advani had won the Hawala case because of him.

Jethmalani's passing was condoled across the political spectrum as for the eminent lawyer did not look at political ideologies while taking up cases.

While he defended BJP leaders like Advani and Amit Shah, he also fought for Delhi Chief Minister Arvind Kejriwal in a defamation case filed by former union minister Arun Jaitley. Similarly, while he defended Kanimozhi, he also fought for J Jayalalitha in the disproportionate assets case.

"I decide according to my conscience who to defend. A lawyer who refuses to defend a person on the ground that people believe him to be guilty is himself guilty of professional misconduct," Jethmalani had once told CNN-IBN in an interview.
