I140 EAD - better than S386..

I think S386 will never pass 😞. ROW will never let it pass. Even though it is a great Bill, it is now pictured as if it favors one country and creates issue for others in future.

WHY IV only concentrates on this bill, Where is plan B?

Instead of that, Why IV or other groups are not fighting for a simple I140 GC Bill. May be time for new leadership. May be the top leaders of IV already have EAD and are waiting for their final GC.

S386 bill is a start but not a final bill.  only benefit people with PD before 2014. it'll reduce the waiting time for others. won't even help any way people with PD after 2017. So how come this will be accepted with UC?

Simple Plan B Bill

The EO passed by Obama in 2015 was interpreted wrongly by USCIS with their discretion and killed the I140-EAD rule. It is easier to work on that front and bring a bill that tells USIS to let applicants apply for EAD after x years of I140 approval.  that x can start with say 5-10 years and can be gradually decreased to limit the work load of USCIS.

This kind of bill will be helpful for any people be Indians or Cambodians. any backlogged people will be benefitted.

It won't piss off any ROW people or Non -IT organizations.

This will benefit everyone from India who has approved I140.

Similar to H4 EAD, We'll wait on i140 EAD, do jobs, open business, and travel freely and when time comes get our GC.

I'm not against to S386, as I mentioned this should at least be a plan B bill. Please give your serious inputs.

Thanks,

What makes you think that USCIS will agree or even align with us on the I-140 EAD? They said that at the I-140 approval stage, the employment basis is established and if we give EAD at this stage, the whole purpose of I-140 is meaningless. Employee has to stay with the employer till he files for I-485 and only after that they can receive an EAD. It took 10 years for s386 to get to UC. If we ask for something else now, get ready to wait for 20 more years.
