Entry with expired visa but valid i94

I got this info from our  legal team and its called automatic revalidation. That means u can travel to Canada or Mexico even with a expired US visa but can return back to US within 30 days if u have a  valid i94. U dont need to get stamped. How many of u are aware of this rule. I am hearing first time.

What Is Automatic Revalidation?

The Department of Homeland Security (DHS) U.S. Customs and Border Protection (CBP) has the authority and the responsibility over the admission of travelers to the United States. Under the automatic revalidation provision of immigration law, certain temporary visitors holding expired nonimmigrant visas who seek to return to the U.S. may be admitted at a U.S. port-of-entry by CBP, if they meet certain requirements, including, but not limited to the following:

  • Nonimmigrants who departed the United States for brief travel to Canada, Mexico, or an adjacent island (for F and J nonimmigrants) for thirty days or less;
  • Nonimmigrants with a valid (unexpired) admission stamp or paper Form I-94, Arrival/Departure Record, endorsed by DHS.

Stamping expire ayi..

New Visa already Approval Notice (approved) ayi unte, yes u can come back within 30days.

but this is restricted only to same category visa..not cross category like F1-->H1

it does not work that way . you cannot use automatic re-validation if you go for stamping .

It’s only for F1 and J1 categories ... I don’t think is applicable for H1

As for what i understand its even for H1. 

If u have valid i797 /I94 even though ur visa is expired u can go to mexico or canada and come back within 30 days without stamping.

Read this para. Canada and Mexico ki andaru eligible but for other islands only F and J categories are eligible.

very old rule . 

for F1 visa you can also go for adjacent island countries ( except cuba )
