Guidance for Our Members 

As we are all going through the roller-coaster of the process and as our lives are stuck, all of us were crushed last week by Senator Durbin’s heartbreaking blockage of the Fairness for High Skilled Immigrants Act. 

We were shocked for many reasons which can be summed up in the following manner – 

1.) We have been working on this bill since 2007, and to see us get so close to the finish line only to have a former Co-sponsor block the bill was truly heartbreaking. 

2.) The manner in which the blockage occurred, where Senator Durbin wanted to bring the bill back to its infancy in a manner that would doom its passage, as opposed to asking for a minor tweak as others have, was also truly heartbreaking. 

3.) Watching Senator Durbin actively solicit and manufacture opposition to our bill in the form of events and actively seeking co-sponsors for his poison pill legislation that cannot attract bipartisan support was even more heart breaking. 

4.) We were heartbroken to see emails from Senator Durbin’s office misinforming his colleagues that only IT workers were in the backlog when the largest source of doctors to the United States are Indian doctors, who are stuck in the same backlogs. 

5.) We know all too well the cost of inaction. Every week we are seeing kids age out of the backlog and fall into undocumented status, we see widows of the backlog have to take their families, uproot and leave the country, and we see families with special needs children uprooted at a moment’s notice. 

This is why it is justifiable that momentarily we lost our cool as collective group of individuals. 

For over a decade we have worked as a nonpartisan organization seeking to raise awareness about the plight of highly skilled immigrants and their families in the backlog. All we seek is equal treatment under the law that is blind to immutable factors like color of the skin and the country of birth, and to see that derailed at the last minute was hurtful and painful to the point of no description. 

Nevertheless, moving forward, we will redouble our effort to continue to hold anyone who opposes S.386/HR1044 as happy warriors and not in an antagonistic fashion. Even if we cannot fathom why Employment-Based immigration law requires employers to discriminate based on national origin, moving forward, we will repudiate the use of the word “racist” to describe anyone who supports maintaining this illogical and unfair system. 

We must be better than the people who seek to impose unequal treatment upon us. We will be better. We will continue to shine an intense and unending light on those who oppose this bill and will inform every one of the consequences of these actions. But unlike our opponents, we will always operate positively moving forward and in good faith. We call on all of our supporters to do the same moving forward. 

Just to be clear, we are not saying we are backing off. Instead, we will be more intense than ever but we will stick to the positive message. Let us highlight facts and the truth surrounding this bill, and people will be able to see that it is a good bill that deserves to be passed. We will not let anyone use our temporary frustration and heartbreak against us for claiming our justifiable and understandable reaction should be held against us. We will be the best version of ourselves at all times, and show America why we are your neighbors, your friends, your co-workers and your doctors. 

We will WIN this struggle for equality. Join us in doing so positively and the right way.
